1. Overview

This website and online store are operated by Brusion Limited, a Colorado corporation ("Brusion", "we", "us", or "our"). Shopify provides the ecommerce platform that enables us to offer our products and services. By visiting brusion.com or purchasing from us, you agree to these Terms of Use and our Privacy Policy.

2. Eligibility and accounts

You must be at least the age of majority in your place of residence to use the Services or place an order. You are responsible for providing accurate, current information and for protecting your account credentials.

3. Handmade products

We make reasonable efforts to describe and photograph products accurately. Screen settings can affect color, and handmade pieces may show small variations in stitching, expression, shape, and fabric placement. These natural variations are part of the product’s character. Measurements are approximate unless stated otherwise.

4. Orders and payment

Submitting an order is an offer to purchase. An order is accepted after payment is authorized and we send confirmation. We may refuse or cancel an order for suspected fraud, pricing or inventory errors, shipping restrictions, or other legitimate reasons. If we cancel a paid order, we will refund the relevant amount. Prices are shown in the currency displayed at checkout; taxes, shipping, duties, and import charges are shown or assessed as applicable.

5. Shipping, returns, and cancellations

Delivery dates are estimates and delays may occur because of carriers, customs, weather, or events outside our control. Shipping terms are described in our Shipping Policy. Returns, refunds, and cancellations are governed by our Refund & Return Policy.

You may use the Services only for lawful, personal purposes. The Brusion name, logos, product designs, photographs, text, graphics, and site presentation are owned by or licensed to Brusion Limited and are protected by applicable intellectual-property laws. You may not reproduce, distribute, modify, sell, or commercially exploit them without prior written permission.

8. Third-party services

The Services may include tools, payment services, applications, or links provided by Shopify and other third parties. Their own terms and privacy policies apply. We are not responsible for third-party websites or services outside our control.

10. Disclaimer

To the extent permitted by law, the website and Services are provided on an “as available” basis. Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot legally be excluded.

11. Limitation of liability

To the fullest extent permitted by law, Brusion Limited and its directors, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential loss arising from use of the Services. This limitation does not apply where liability cannot legally be limited or excluded.

12. Indemnification

You agree to indemnify Brusion Limited against third-party claims and reasonable costs arising from your unlawful use of the Services, your breach of these Terms, or your infringement of another person’s rights, to the extent permitted by law.

13. Governing law

These Terms are governed by the laws of the State of Colorado and applicable United States federal law, without limiting any mandatory consumer protections available in your place of residence.

14. Changes and severability

We may update these Terms by posting a revised version on this page. If any provision is found unenforceable, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver.
